Queen’s son remains in custody

He was allowed to take part in funeral rituals for his step-grandfather King Harald in September, but Marius Borg Høiby otherwise remains in custody while his rape conviction is under appeal. He had sought release from the electronic ankle cuff that confines him to a house on the royal estate at Skaugum.

Høiby, the 29-year-old son of Queen Mette-Marit, had won his custody appeal to the Oslo County Court earlier this week, but then prosecutors appealed and prevailed on Wednesday. They pointed to how Høiby had tested positive for drinking alcohol and that’s a violation of his custody terms outside prison walls.

The new appeals court ruling means Høiby must continue to wear the ankle cuff and comply with other conditions of his custody while he awaits a new trial in February. Prosecutors had sought a seven-year prison term but he was convicted and sentenced earlier this year to four years in prison for two rapes, violence and violation of restraining orders against an earlier partner among other charges.

He was released from prison pending appeal, however, and allowed to return to the house he’s been using on the royal estate, where he’s also allowed to visit his mother for three hours every day. He has appealed his four-year sentence, with that trial due to begin in February.
